Your Employer’s Eligibility

Your New Brunswick employer must meet these requirements to support your application. Otherwise, your application will be refused. ImmigrationNB may contact your employer for further information.

1. Genuine and Continuous Active Operations

Your employer must:

  • Have a valid registration to hire foreign workers with New Brunswick’s Registry of Employers of Foreign Workers.
  • Operate from a physical structure owned or leased by the employer.
  • Have both a street and a mailing address in New Brunswick.
  • Have clear signage for the organization at the location of operation.
  • Have a telephone service in the organization’s name.
  • Have been actively operating in New Brunswick for at least 24 months.
  • Be actively engaged in the business operation.
  • Be in good standing with provincial and federal laws, including the Employment Standards Act (ESA), the Immigration and Refugee Protection Act (IRPA), and the Immigration and Refugee Protection Regulations (IRPR).

2. Genuine Employer-Employee Relationship

Your employer must be directly involved in your hiring process. Placement agencies hiring workers for another employer cannot support your application. Additionally, neither you nor your spouse/common-law partner can be a majority shareholder in the company supporting your application.

3. Genuine Labour Shortage & Recruitment

Your employer must demonstrate unsuccessful local recruitment efforts before being invited to participate in international recruitment missions led by the Government of New Brunswick (GNB). ImmigrationNB may request further proof that your job offer resulted from one of these missions.

4. Employer Support Requirements

Your employer must:

  • Offer you a full-time, non-seasonal job.
  • Complete and sign the NB-004 Employment Information Form.
  • Be willing to pay a federal compliance fee of CAD $230 and submit an offer of employment through IRCC’s Employer Portal if you need a work permit. This fee cannot be passed on to you. If the employer refuses to pay and you cannot obtain a work permit by other means, your application will be refused.

Application Process

1. Job Offer

  • Secure a valid job offer from an eligible New Brunswick employer who is willing to support your application.

2. Expression of Interest (EOI)

  • Create an account on the INB portal (www.inb.gnb.ca) and submit your Expression of Interest (EOI).
  • Submitting an EOI is free of charge.
  • If your profile meets eligibility and labour market needs, ImmigrationNB may invite you to apply.

3. Provincial Nomination Application

  • If you receive an Invitation to Apply (ITA), you have 45 calendar days to submit a complete application via the INB portal and pay the processing fee.
  • If you miss the deadline, you must submit a new EOI.
  • Receiving an ITA does not guarantee nomination.
  • You must meet all eligibility criteria before applying.
  • The stream cannot be changed after applying.
  • You can only have one active application with ImmigrationNB at any time. If multiple applications exist, you must choose one and withdraw the others (fees are non-refundable).

4. Assessment

  • ImmigrationNB checks for completeness (all required documents submitted).
  • Your application is then assessed based on eligibility criteria.
  • You may be asked to provide additional documents, attend an interview, or receive a phone call from an officer.
  • You may voluntarily withdraw your application unless a Procedural Fairness Letter (PFL) has been issued.
  • If ImmigrationNB identifies concerns, a PFL will be issued, and you must respond by the given deadline.

5. Provincial Decision

  • Nomination: If approved, you receive a nomination certificate via the INB portal (valid for 6 months). You must apply for permanent residence before it expires and maintain your nomination conditions while waiting for a decision.
  • Refusal: If you fail to meet the requirements, your application will be refused, and you will receive a refusal letter via the INB portal.

6. Federal Permanent Residence Application

  • You are responsible for submitting your permanent residence application to IRCC.
  • You and your family members must meet IRCC’s requirements, including medical, security, and criminal checks.

7. Decision from IRCC

  • IRCC makes the final decision on your permanent residence application.
  • Nomination does not guarantee approval by IRCC.

8. Landing in Canada

  • Within 30 days of receiving your Confirmation of Permanent Residence (COPR), log in to the INB portal.
  • Click “Report PR Landing” and complete the form.
