Temporary foreign workers in P.E.I. benefiting from new legal protections and fair work regulations.

The government of Prince Edward Island (P.E.I.) is introducing new rules starting April 1, 2025, to better protect temporary foreign workers. These rules will make sure workers are treated fairly and that recruiters follow strict guidelines.

What Are the New Protections?

Under the new Temporary Foreign Worker Protection Act, the following protections will be in place:

  1. No Extra Fees for Workers – Recruiters and employers cannot charge foreign workers any extra fees for job placement or other services.
  2. No False Information – Employers and recruiters must be honest about:
    • Job responsibilities
    • Wages and benefits
    • Housing conditions
    • Immigration and work rules
    • Any other important details
  3. No Taking of Documents – Employers cannot take or keep workers’ passports or important papers (except briefly for copying or recording information).
  4. No False Promises – Job opportunities must be real and match what was promised in terms of wages, duties, and length of employment.
  5. No Threats or Deportation Scare Tactics – Employers cannot threaten workers with deportation or any unfair punishments.

New Rules for Recruiters

Starting July 1, 2025, anyone helping employers find foreign workers in P.E.I. must have a recruiter licence.

  • Unlicensed recruiters could be fined up to $5,000.
  • To get a licence, recruiters must pay a $100 fee and provide a $10,000 security deposit.

However, the following people don’t need a recruiter licence:

  • Employers recruiting workers for their own business
  • Family members recruiting relatives
  • Government representatives
  • Universities and colleges hiring workers

Why Is This Happening?

Last year, a United Nations report criticized Canada’s temporary foreign worker program, calling it a “breeding ground for modern slavery.” P.E.I. wants to ensure that foreign workers are treated fairly and have safe living conditions.

To improve worker housing, the government has also introduced a grant program that provides farms with up to $15,000 to upgrade accommodations for temporary foreign workers.

🔹 Can my employer keep my passport for safety reasons?

  • No! Employers cannot hold onto your passport or important documents.

🔹 What happens if a recruiter tries to charge me extra money?

  • That is illegal! You should report them to the P.E.I. government.

🔹 I was promised a higher salary, but my employer is paying me less. What can I do?

  • Employers must pay you what was agreed. If not, you can file a complaint.

🔹 Do I need to pay anything to a recruiter?

  • No. Recruiters cannot charge you for getting a job in P.E.I.

🔹 How will the government check if these rules are followed?

  • Employers and recruiters will have to follow strict regulations, and those breaking the rules could face fines and penalties.
